Professor emeritus Lars Hjerner har avlidit 84 år gammal genom en plötslig olyckshändelse. Hans närmaste är systern Ulla Hjerner-Bengtsson.
Lars Hjerner föddes i en ämbetsmannafamilj och tillhörde den generation som formades av beredskapstiden under andra världskriget. Efter ett gästspel i flygvapnet satsade han på juridiska studier och fann sig väl tillrätta vid dåvarande Stockholms högskola, där han blev känd och uppskattad som en stor spexförfattare.
Han tog sin jur kand 1944 och fortsatte sedan parallellt med studier och tjänstgöring bland annat som fiskal vid Svea hovrätt. År 1957 disputerade han på avhandlingen ”Främmande valutalag och internationell privaträtt”, en av de främsta juridiska avhandlingarna i Sverige. Den behandlar inte endast lagval utan innehåller också en bred och djupgående penetrering av grundläggande civilrättsliga frågor.
Lars Hjerner blev professor i allmän rättslära 1963 och i internationell rätt 1967, båda vid Uppsala universitet. Han tillträdde 1975 professuren i internationell rätt vid Stockholms universitet och innehade denna tjänst fram till emeriteringen 1988. Utmärkande för denna period var hans aktiva engagemang i att främja forskningen inom folkrätt. Detta ledde till det för juridiken ovanliga resultatet av åtta disputationer under tolv år.
Han hade en varm, informell och vänlig attityd gentemot sina doktorander. Hans regelbundna doktorandseminarier i folkrätt var alltid en inspirationskälla och ett forum för intressanta diskussioner mellan lärare och doktorander från Stockholm och Uppsala. Han var särskilt intresserad av de rent juridiska delarna av folkrätten och undvek avsiktligt att uttala sig om de mer politiska delarna, såsom internationellt bruk av våld.
Intresset för internationell civilrätt präglade stora delar av hans arbete där han utmärkte sig för synnerligen skarpsinniga och respektingivande insatser. Lars Hjerner innehade befattningen som vice president i Internationella handelskammarens kommission för internationell handelsrätt och var ledamot av Academic Council of the Institute of International Business Law and Practice.
Han deltog även som ledamot av internationella organ inom skiljemannarätten, bland annat i Stockholms universitets Vetenskapliga institut för skiljemannarätt. Han deltog som svensk delegat vid utformningen av den internationella köplagen och i den nordiska arbetsgrupp som förberedde vår nuvarande köplag. I detta arbete visade han konsekvent prov på sin grundsyn att väl genomtänkta och strukturerade rättsregler inte bör ersättas av sådana som ger rättstillämparen alltför stort utrymme att godtyckligt handla efter läglighet.
Lars Hjerner var aktiv i International Law Association (ILA), såväl i dess internationella möten och arbetsgrupper som i den svenska avdelningens verksamhet. Under flera år var han styrelseledamot och ordförande av svenska ILA.
På det internationella planet hade han goda personkontakter som han utvecklade med sin underfundiga humor. Han deltog i ILA:s arbetsgrupper om International Monetary Law, Commercial Arbitration, State Immunity och International Securities Regulation.
Han var också engagerad i frågor kring Europakonventionen om de mänskliga rättigheterna och gjorde framgångsrika insatser i mål inför konventionsorganen i Strasbourg, vilka ledde till svensk lagändring (Bramelid och Malmström) respektive stor internationell uppmärksamhet (Max von Sydows skattetillägg som staten föredrog att förlika). Han stod rakryggad emot alla lättköpta juridiska resonemang och var inte benägen att offra klarhet för kompromisser, oavsett hur viktiga de kunde anses vara för att få till stånd internationell rättsenhet. Han vände sig med kraft och förakt mot den så kallade skatteflyktsklausulen som dörröppnare för myndigheternas godtycke.
Lars Hjerners verklighetsanpassning i det privata livet kunde ta sig överraskande uttryck som när han i hårt väder i en läckande segelbåt slutade pumpa för att han ”ville spara de sista krafterna för att kunna simma i land”. Han var en god kamrat att ha med sig även i äventyrliga sammanhang.
Nu när Lars Hjerner lämnat oss för alltid efterlämnar han minnet av en skarpsinnig och skarptungad jurist med stort sinne för det överdrivna och maktfullkomliga i myndighetsexpansionen; hans skepsis lättade många bördor för dem som hamnat snett i grottekvarnen och hans spetsiga humor gjorde livet lättare för oss som hade fördelen att ha fått känna honom närmare.
